Operator

Voyagante is developed and operated by Tomoaki Ando, an independent developer in Japan. These Terms apply to the Voyagante mobile application, its digital content, and related website services.

Eligibility and accounts

You must have legal capacity to enter into these Terms. If you are a minor under the law that applies to you, use Voyagante only with permission from a parent or legal guardian.

You must provide accurate account information, protect your credentials, and promptly notify us of suspected unauthorized access. You are responsible for activity performed through your account to the extent permitted by law.

License

Subject to these Terms, Voyagante grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and non-commercial license to use the app and access legitimately acquired content.

This license may be suspended or revoked for a material breach, fraud, security risk, unauthorized use, or where permitted or required by law. Purchasing content does not transfer ownership of intellectual property.

Prohibited conduct

You may not share or sell accounts; copy, record, redistribute, publicly perform, or commercially exploit protected content; bypass payment, access, or device controls; scrape or automatically extract data; reverse engineer, decompile, or tamper with the app except where law expressly permits; introduce malicious code; impersonate another person; or access systems or content without authorization.

Responsible use and safety

Voyagante accompanies cultural and tourist exploration but does not replace official instructions, signage, safety rules, or guidance from authorities and venue operators.

Remain aware of traffic, people, stairs, terrain, weather, and local restrictions. Use headphones responsibly. You are responsible for deciding whether conditions are safe for using the app.

Content

Content is provided for cultural, educational, informational, and recreational purposes. We make reasonable efforts to maintain it but do not guarantee that descriptions, opening hours, access conditions, events, or other destination information are complete, current, or error-free.

Prices and digital purchases

Destinations, audio guides, and other in-app content are digital products. Prices, currencies, taxes, purchase confirmations, payment processing, and available purchase options are shown and governed by Google Play or the Apple App Store, together with applicable law.

Purchases may be tied to a specific account and store platform, are not transferable between accounts, and may not transfer between platforms. Deleting an account may prevent restoration of previously purchased digital content.

Refunds and subscriptions

Except where permitted by Google Play or Apple App Store policies or required by applicable law, completed digital purchases are non-refundable. Refund requests must follow the process of the store used for the purchase or be sent to us when the store directs the user to the developer.

If subscriptions are offered, deleting a Voyagante account or uninstalling the app does not automatically cancel them. They must be managed through the store account used to subscribe.

Device use and restoration

Voyagante may limit an account to one active device for security, purchase validation, and prevention of unauthorized use. Changing devices may require activation and purchase validation. Restoration depends on store records, platform compatibility, technical availability, and the continued existence of the account.

Location and local storage

Location is used while the app is in use to show position and automatically play content near points of interest. Accuracy and timing depend on the device, GPS, connectivity, permissions, and environmental conditions.

Some content and settings are stored locally. Clearing app data or uninstalling the app may delete downloads, favorites, visited status, settings, and other local information.

Service availability and changes

The service may require internet access, permissions, local storage, compatible hardware, and third-party services. We do not guarantee uninterrupted availability in every region, device, or network condition.

We may maintain, update, modify, discontinue, or replace features or content. Where reasonably possible, material changes that significantly affect paid content or user rights will be communicated in advance.

Suspension and termination

We may suspend or restrict access when reasonably necessary to investigate or address fraud, prohibited conduct, security threats, legal requirements, or material breaches of these Terms. Where appropriate, we will provide notice and an opportunity to contact support.

Termination or deletion ends the license to use the account and may prevent restoration of content. Provisions concerning intellectual property, liability, governing law, and obligations that by nature should survive will continue to apply.

Third-party services

Voyagante depends on services such as Firebase, Google, Apple, OpenStreetMap, and Cloudflare. Their own terms may apply. We do not control their operation and are not responsible for outages or changes outside our reasonable control, subject to mandatory law.

Intellectual property

Voyagante and its original software, design, text, audio, images, trademarks, and other materials are owned by or licensed to the operator and are protected by intellectual-property laws. No rights are granted except the limited license expressly stated in these Terms.

Disclaimers

Voyagante is provided on an “as available” basis and according to its actual functionality at any given time. To the maximum extent permitted by law, we disclaim implied warranties that may legally be excluded. Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot lawfully be excluded.

Limitation of liability

To the maximum extent permitted by law, Voyagante is not liable for indirect, incidental, or consequential loss resulting from external conditions, inaccurate third-party information, location limitations, connectivity, closures, weather, or misuse of the app.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability arising from intentional misconduct or gross negligence, or limits mandatory consumer rights.

Changes to these Terms

We may update these Terms for legal, security, technical, or functional reasons. The updated version and effective date will be published on the website. For material changes, we will provide reasonable notice where required. Continued use after the effective date constitutes acceptance only to the extent permitted by law.

Governing law

These Terms are governed by the laws of Japan, without prejudice to mandatory consumer-protection rights available in the user’s country of residence. Nothing here requires a consumer to waive a court, remedy, or protection that applicable law makes mandatory.

Language

These Terms may be provided in several languages. If translations differ, the English version prevails, unless applicable law requires otherwise.

Severability and no waiver

If any provision is found invalid or unenforceable, it will be applied to the maximum lawful extent and the remaining provisions will continue in effect. Failure to enforce a provision is not a waiver of the right to enforce it later.
